Overview

Welcome to PosturePow. The terms "we", "us", "our" and "PosturePow" refer to Triumph Capital Commerce LLC, a Wyoming limited liability company doing business as PosturePow. PosturePow operates the website posturepow.com, including all related information, content, features, tools, products and services (the "Services"). PosturePow is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced below — our Privacy Policy, Shipping Policy and Cancellation, Return & Refund Policy — (together, the "Terms") describe your rights and responsibilities when you use the Services. By visiting, interacting with or purchasing through the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Section 1 – Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province or country of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including purchasing products, you may be asked to provide information such as your email address, billing, payment and shipping information. You represent that all information you provide is correct, current and complete. You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

Section 2 – Our Products

We make every effort to represent our products accurately. However, colors and product appearance may differ slightly from how they appear on your screen depending on your device and settings. Product descriptions, specifications and availability may change at any time without notice. We reserve the right to discontinue any product and to limit the quantities we offer to any person, region or jurisdiction.

Our products are comfort and posture-support accessories. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. If you have a medical condition, please consult a qualified healthcare professional before use. Individual results vary.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is accepted only once we confirm it and your payment has been processed. If we decline, change or cancel an order, we will notify you using the email, billing address and/or phone number provided at checkout, and any payment for a cancelled order will be refunded in full.

Order cancellations, returns and refunds are handled under our Cancellation, Return & Refund Policy. You represent that your purchases are for your own personal or household use and not for commercial resale.

Section 4 – Prices, Promotions and Billing

All prices are shown in US dollars unless otherwise stated. Prices, discounts and promotions may change without notice, but the price charged for your order is the price in effect when you place it, as shown in your order confirmation. Shipping costs are shown at checkout and described in our Shipping Policy. For orders shipped to the UK, European Union, Canada, Australia and New Zealand, import duties and taxes are included in the price you pay at checkout.

Discount codes and promotions are subject to their stated conditions (for example, one use per customer or no combining with other offers). Where offers cannot be combined, the offer that gives you the greater saving will apply.

You agree to provide current, complete and accurate payment information and represent that (i) the payment information you provide is true and correct, (ii) you are authorized to use the payment method, and (iii) charges incurred by you will be honored by your card issuer or payment provider.

Section 5 – Shipping and Delivery

We ship to the destinations listed in our Shipping Policy. Delivery times are estimates and are not guaranteed; delays may occur due to carriers, customs processing or events outside our control.

If your package is lost or damaged in transit, we will resolve it with a replacement or refund as described in our Shipping Policy. Please make sure your shipping address is complete and accurate — packages that cannot be delivered because of an incorrect address, refused delivery or non-collection are handled as described in our Shipping Policy and Cancellation, Return & Refund Policy.

Section 6 – Intellectual Property

The Services, including all trademarks, brand names, text, images, graphics, video, product names and the design and arrangement of the website, are owned by Triumph Capital Commerce LLC (PosturePow), its affiliates or licensors, and are protected by U.S. and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display or otherwise use any material from the Services without our prior written consent.

PosturePow, CervAlign Pro, SACRA and related names and logos are trademarks of Triumph Capital Commerce LLC. Shopify's name and logos are trademarks of Shopify. All other trademarks belong to their respective owners.

Section 7 – Optional Tools

We may provide access to third-party tools that we do not monitor or control. Such tools are provided "as is" and "as available" without warranties of any kind, and your use of them is at your own risk and subject to the third party's terms. New features added to the Services are also subject to these Terms.

Section 8 – Third-Party Links

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, products or practices of third-party websites, and you access them at your own risk. Please review their policies before engaging in any transaction.

Section 9 – Relationship with Shopify

PosturePow is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Triumph Capital Commerce LLC (PosturePow). By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PosturePow, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PosturePow.

Section 10 – Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is transmitted to and processed by Shopify and third-party service providers that may be located in countries other than where you live.

Section 11 – Reviews and Feedback

If you submit reviews, ideas, suggestions or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, publish and display that Feedback in any medium, including for marketing. You represent that your Feedback is your own honest opinion, reflects your genuine experience, does not violate anyone's rights, and discloses any compensation or incentive you received for it. We may, but are not obliged to, remove Feedback that is unlawful, offensive or violates these Terms.

Section 12 – Errors, Inaccuracies and Omissions

Information on the Services may occasionally contain errors relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct such errors and to update information or cancel orders if information is inaccurate, including after you have submitted an order. If we cancel an order for this reason, you will receive a full refund.

Section 13 – Prohibited Uses

You may use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or fraudulent purpose; (b) to violate any laws or regulations; (c) to infringe our or others' intellectual property rights; (d) to harass, abuse, defame or harm any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited advertising; (g) to impersonate any person or entity; (h) to upload viruses or malicious code; (i) to scrape, copy or extract content using robots, scrapers or automated tools, including AI agents, except as permitted in Section 14; or (j) to interfere with or bypass the security features of the Services. We may suspend or terminate access for any violation of these Terms.

Section 14 – Automated Agents

Any software or service that acts autonomously or semi-autonomously on someone's behalf ("Agent") may access the Services only if it clearly identifies itself (including "Agent/[agent name]" in its user-agent string), does not disguise automated activity as human activity, does not circumvent CAPTCHAs or other access controls, and stops accessing the Services if we ask it to. We may limit or block Agent access at any time.

Section 15 – Termination

We may terminate these Terms or your access to the Services at any time, and you remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification and Governing Law) will continue to apply.

Section 16 – Disclaimer of Warranties

Except as expressly stated in our Shipping Policy and Cancellation, Return & Refund Policy (including our 60-Day Quality Guarantee), the Services and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits your statutory rights as a consumer.

Section 17 – Limitation of Liability

To the fullest extent permitted by law, PosturePow and its members, officers, employees, affiliates, agents, contractors and service providers (and Shopify and its affiliates) will not be liable for any indirect, incidental, punitive, special or consequential damages, or for lost profits, revenue, savings or data, arising from your use of the Services or any product. Our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Section 18 – Indemnification

You agree to indemnify and hold harmless PosturePow, Shopify and their affiliates, officers, employees, agents and service providers from any third-party claims, losses and reasonable attorneys' fees arising from (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services.

Section 19 – Severability

If any provision of these Terms is found unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect.

Section 20 – Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms and the policies referenced in them are the entire agreement between you and us regarding the Services and supersede any prior agreements or communications.

Section 21 – Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice to you.

Section 22 – Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you are a consumer living outside the United States, you also benefit from any mandatory consumer-protection laws of your country of residence, and nothing in these Terms affects those rights.

Section 23 – Headings

Headings are for convenience only and do not affect the interpretation of these Terms.

Section 24 – Changes to These Terms

We may update these Terms from time to time by posting the updated version on this page and changing the "Last updated" date. Material changes will be notified as required by applicable law. The version in effect at the time you place an order applies to that order.
